Today, global warming and sea level rise resulted from polar ice melting are the most immediate, definitive, and visible effects of climate change. One of the effects of these changes is the likelihood that coastal states, especially small island states, will be deprived of their former maritime zones. Since the baseline is the basis of determination of the maritime zones of the coastal state, with sea level rise, the validity of previous baselines and countries' eligibility for making use of maritime zones have been challenged. It raises the question of whether such countries are still eligible to use the existing baselines or should redraw baselines based on changes. The purpose of this paper was to examine the effects of climate change on baselines of the coastal and archipelagic states and to provide solutions to these countries to counter such effects. Material and methods: In order to examine the impacts of climate change on coastal countries, we first discussed the effects of climate change on the oceans. Research shows that the most important of these changes is global warming and sea level rise. Then, the impact of such consequences on the normal and direct baselines of the coastal and archipelagic states was analyzed. Results and discussion: We concluded that the most important effects of such changes on the oceans are global warming and sea level rise. Then, the impact of climate change on the baselines and the authenticity of this legal challenge were assessed. It was concluded that however the Convention on the Law of the Sea 1982 neglected the potential of future changes to base points, by interpreting the drawing of baselines of unstable coastlines and continental shelf, it is possible to accept the right of coastal and archipelagic states to preserve the existing baselines and maritime zones despite sea level changes. Conclusion: This study concluded that the consequences of climate change undoubtedly lead to widespread changes in baselines, and by interpreting the provisions of the convention, it can provide solutions to counter these changes, and eventually, acknowledge the right of coastal states to preserve their former baselines.}, keywords = {climate change,Convention on the Law of the Sea,Base points,Baseline,Maritime zones}, title_fa = {تغییرات اقلیمی و تغییرات خطوط مبدأ کشورهای ساحلی: راهکارها و چالش‌ها}, abstract_fa = {سابقه و هدف: توانایی بشر برای دگرگون ساختن محیط زیست در تمام کره زمین به نوع متفاوتی از نگرانیهای محیط زیستی یعنی تغییرات اقلیمی دامن زده است. امروزه افزایش گرمایش جهانی و باال آمدن آب دریاها در اثر آب شدن یخهای قطبی، فوری ترین، قطعی ترین و گسترده ترین اثرهای قابل مشاهده تغییرات اقلیمی است. یکی از آثار این تغییرات، احتمال محروم شدن کشورهای ساحلی بویژه کشورهای کوچک جزیرهای از قلمروهای دریایی قبلی شان است، زیرا با باال آمدن آب دریاها نقاط پایه ای که مبنای ترسیم خطوط مبدأ هستند شروع به پسرفت به سمت ساحل نموده و عوارض طبیعی که مبنایی برای ترسیم خطوط مبداء دریای سرزمینی یا آبهای مجمع الجزایری بودند در حال غرق شدن یا تغییر ماهیت هستند. از آنجایی که خط مبدأ مبنای تعیین حدود مناطق دریایی کشور ساحلی است، با باال آب دریاها اعتبار خطوط مبدأ ترسیم شده قبلی و استحقاق کشورها برای برخورداری از منطقه های دریایی برمبنای چنین خطوطی به چالش کشیده شده و این مساله را مطرح میسازد که چنین کشورهایی همچنان سزاوار استفاده از خطوط مبدأ ترسیم شده قبلی هستند یا باید به ترسیم دوباره این خطوط بر اساس تغییرات صورت گرفته اقدام کنند. از اینرو هدف این نوشتار بررسی آثار تغییرات اقلیمی بر خطوط مبدأ کشورهای ساحلی و مجمع الجزایری و بیان راهکارهایی به چنین کشورهایی برای مقابله با چنین آثاری است. مواد و روشها: به منظور بررسی آثار تغییرات اقلیمی بر کشورهای ساحلی در ابتدا به پیامدهای تغییرات اقلیمی بر اقیانوسها پرداخته شد. با توجه به تحقیق های صورت گرفته مشخص شد، مهمترین این تغییرات، گرمایش جهانی و باال آمدن آب دریاها است. سپس تأثیر چنین پیامدهایی بر خطوط مبدأ عادی و مستقیم کشورهای ساحلی و مجمع الجزایری مورد تجزیه و تحلیل قرار گرفت. نتایج و بحث: این نوشتار با بررسی آثار تغییرات اقلیمی بر اقیانوسها به این نتیجه رسید که مهمترین آثار چنین تغییراتی بر اقیانوسها گرمایش جهانی و باال آمدن آب دریاست. این مطالعه با ارزیابی تأثیر تغییرات اقلیمی بر خطوط مبدأ به بررسی واقعی بودن این چالش حقوقی نسبت به انواع خطوط مبدأ پرداخته و نتیجه میگیرد که با وجود آنکه کنوانسیون حقوق دریاها 1982 به معضل تغییرات احتمالی بعدی در محل نقاط پایه بی توجه بوده و در این رابطه سکوت کامل دارد، با اینحال با تفسیر مواد کنوانسیون در مورد ترسیم خطوط مبدأ سواحل ناپایدار و فالت قاره میتوان قائل به حق کشورهای ساحلی و مجمع الجزایری به حفظ خطوط مبدأ قبلی و منطقه های دریایی موجود به رغم تغییرات سطح دریا شد. نتیجه گیری: این مطالعه با ارزیابی آثار تغییرات اقلیمی بر خطوط ساحلی کشورهای ساحلی نتیجه میگیرد که بی تردید پیامدهای تغییرات اقلیمی منجر به تغییرات گسترده در خطوط مبدأ کشورهای ساحلی میشود و با تفسیر مواد کنوانسیون حقوق دریاها میتوان راهکارهایی برای مقابله با این تغییرات بیان نمود و در نهایت قائل به حق کشورهای ساحلی به حفظ خطوط مبدأ قبلی آنها شد.}, keywords_fa = {تغییرات اقلیمی,کنوانسیون حقوق دریاها,نقاط پایه,خط مبدأ,منطقه های دریایی}, url = {https://envs.sbu.ac.ir/article_98159.html}, eprint = {https://envs.sbu.ac.ir/article_98159_da41a2af2eb2b74708b66a00c4ea0402.pdf} }
